Article 1 - Definitions

In these conditions the following terms have the following meanings:

1. Entrepreneur: the natural or legal person who offers products and / or services to consumers at a distance; Hereafter 4 Telecom Center (4TC).

2. Legal person: the person who acts in the name of a profession or business and who enters into a distance contract with the entrepreneur; hereafter named the customer

3. Distance contract: an agreement whereby, within the framework of a system for distance selling of products and / or services organized by the entrepreneur, up to and including the conclusion of the agreement, use is exclusively made of one or more communication techniques. distance;

4. Technology for distance communication: means that can be used for the conclusion of an agreement, without the customer and entrepreneur having come together in the same space at the same time;

5. Duration transaction: a distance contract with regard to a series of products and / or services, the delivery and / or purchase obligation of which is spread over time;

6. Durable data carrier: any means that enables the customer or entrepreneur to store information that is addressed to him personally in a way that allows future consultation and unaltered reproduction of the stored information.

7. Day: calendar day;

8. Reflection period: the period within which the customer can exercise his right of withdrawal;

9. Right of withdrawal: the possibility for the customer to withdraw from the distance contract within the cooling-off period;

Article 3 - Applicability

These general terms and conditions apply to any offer from 4TC and to any distance contract concluded between 4TC and the customer.

Before the distance contract is concluded, the text of these general terms and conditions will be made available to the customer. If this is not reasonably possible, before the distance contract is concluded, it will be indicated that the general terms and conditions can be viewed at 4TC and that they will be sent free of charge at the request of the customer.

If the distance contract is concluded electronically, notwithstanding the previous paragraph and before the distance contract is concluded, the text of these general terms and conditions can be made available to the consumer electronically in such a way that the consumer can be easily stored on a durable data carrier. If this is not reasonably possible, before the distance contract is concluded, it will be indicated where the general terms and conditions can be consulted electronically and that they will be sent free of charge electronically or otherwise at the request of the customer.

In the event that specific product or service conditions apply in addition to these general terms and conditions, the second and third paragraphs apply mutatis mutandis and the consumer can always invoke the applicable provision that is most favorable to him in the event of conflicting general terms and conditions. is.

Article 4 - The offer

If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.

The offer contains a complete and accurate description of the products and / or services offered. The description is sufficiently detailed to allow a proper assessment of the offer by the consumer. If images are used, they are a true representation of the products and / or services offered. Obvious mistakes or errors in the offer do not bind 4TC.

Each offer contains such information that it is clear to the consumer what rights and obligations are attached to the acceptance of the offer. This concerns in particular:

- the price excluding taxes;

- any delivery costs;

- the manner in which the agreement will be concluded and which actions are required for this;

- whether or not the right of withdrawal applies;

- the method of payment, delivery or implementation of the agreement;

- the period for accepting the offer, or the period for adhering to the price;

- the level of the rate for distance communication if the costs of using the technique for distance communication are calculated on a basis other than the basic rate;

- if the contract is filed after conclusion, how it can be consulted by the customer;

- the way in which the customer can obtain information about actions he does not want before concluding the contract, as well as how he can rectify these before the contract is concluded;

- any languages ​​in which, in addition to Dutch, the contract can be concluded;

- the codes of conduct to which 4TC is subject and the way in which the consumer can consult these codes of conduct electronically; and

- the minimum duration of the distance contract in the event of an agreement that involves the continuous or periodic delivery of products or services.

Article 5 - The agreement

The agreement is concluded, subject to the provisions of paragraph 4, when the customer accepts the offer and meets the corresponding conditions. If the customer has accepted the offer electronically, 4TC will immediately electronically confirm receipt of the acceptance of the offer. As long as the receipt of this acceptance has not been confirmed, the consumer can dissolve the agreement.

If the agreement is concluded electronically, 4TC will take appropriate technical and organizational measures to protect the electronic transfer of data and ensure a safe web environment. If the consumer can pay electronically, 4TC will take appropriate security measures to that end. 4 Telecom Center can - within legal frameworks - inform itself whether the consumer can meet his payment obligations, as well as all those facts and factors that are important. for a responsible conclusion of the distance contract.

If, on the basis of this investigation, 4TC has good reasons not to enter into the agreement, it is entitled to refuse an order or request, stating reasons, or to attach special conditions to the execution.

4 Telecom Center will enclose the following information with the product or service to the customer, in writing or in such a way that it can be stored by the consumer in an accessible manner on a durable medium:

- the visiting address of the 4TC location where the customer can go with complaints;

- the conditions under which and the manner in which the customer can exercise the right of withdrawal, or a clear statement regarding the exclusion of the right of withdrawal;

- information about existing after-sales service and guarantees;

- the information included in article 4 paragraph 3 of these conditions, unless 4TC has already provided this information to the customer before the execution of the agreement;

- If 4TC has undertaken to supply a series of products or services, the provision in the previous paragraph applies only to the first delivery.

Article 6 - Right of withdrawal on delivery of products

When purchasing products, the customer has the option to dissolve the contract without giving any reason during fourteen days. This period commences on the day after receipt of the product by or on behalf of the customer.

During this period, the customer will handle the product and packaging with care. He will only unpack or use the product to the extent necessary to assess whether he wishes to keep the product. If he makes use of his right of withdrawal, he will return the product with all accessories and - if reasonably possible - in the original condition and packaging to 4TC, in accordance with the reasonable and clear instructions provided by 4TC.

Article 7 - Costs in case of withdrawal

If the customer makes use of his right of withdrawal, at most the costs of return will be for his account.

If the customer has paid an amount, 4TC will refund this amount as soon as possible, but no later than 30 days after the return or cancellation.

Article 8 - The price

During the period of validity stated in the offer, the prices of the products and / or services offered will not be increased, except for price changes as a result of changes in VAT rates.

Contrary to the previous paragraph, 4TC can offer products or services whose prices are subject to fluctuations in the financial market and which 4TC has no influence on, with variable prices. This link to fluctuations and the fact that any stated prices are target prices are stated in the offer.

Price increases within 3 months after the conclusion of the agreement are only permitted if they are the result of statutory regulations or provisions.

Price increases from 3 months after the conclusion of the agreement are only permitted if 4TC has stipulated this and:

- they are the result of statutory regulations or provisions; or

- the consumer has the authority to cancel the contract on the day on which the price increase takes effect.

The prices stated in the offer of products or services are always stated exclusive of VAT. This offer is binding subject to manifest error or oblivion.

Article 9 - Conformity and warranty

4TC guarantees that the products and / or services meet the agreement, the specifications stated in the offer, the reasonable requirements of reliability and / or usability and the legal provisions existing on the date of the conclusion of the agreement and / or government regulations.

An arrangement offered by 4TC, manufacturer or importer as a guarantee does not affect the rights and claims that the customer can assert with regard to a shortcoming in the fulfillment of the obligations of 4TC towards 4TC under the law and / or the agreement. at a distance.

Article 10 - Delivery and execution

4TC will take the greatest possible care when receiving and implementing orders for products and when assessing applications for the provision of services.

The place of delivery is the address that the customer has made known to the company.

With due observance of what is stated in article 4 of these general terms and conditions, the company will execute accepted orders expeditiously, but at the latest within 30 days, unless a longer delivery period has been agreed. If delivery is delayed, or if an order cannot or only partially be executed, the customer will be notified of this no later than one month after placing the order. In that case, the costumer has the right to terminate the contract without costs.

In case of dissolution in accordance with the previous paragraph, 4TC will refund the amount that the customer has paid as soon as possible, but no later than 30 days after dissolution.

If delivery of an ordered product proves to be impossible, 4TC will discuss with the customer as soon as possible, but within 30 days after the customer has placed the order, to send a replacement item or to make a refund for the item concerned.

4TC can only be held liable for transport damage that can be attributed to its intent or gross negligence or that has arisen due to circumstances that are at its risk under mandatory rules. Insured shipping is always an option.

Article 11 - Payment

- Unless otherwise agreed, the amounts owed by the customer must be paid before 4TC delivers.

- In the event of advance payment, the customer cannot assert any rights regarding the execution of the order or service (s) concerned before payment has been made.

- The customer has the duty to report inaccuracies in payment details provided or stated to 4TC without delay.

- In case of default by the customer, 4TC has the right, subject to legal restrictions, to charge the reasonable costs made known to the customer in advance.

Article 12 - Complaints procedure

4TC has a well-publicized complaints procedure and handles the complaint in accordance with this complaints procedure.

Complaints about the implementation of the agreement must be submitted to 4TC within a reasonable time, fully and clearly described, after the customer has discovered the defects, but not after 5 working days after the delivery date.

Complaints submitted to 4TC will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeable longer processing time, 4TC will respond within the period of 14 days with a message of receipt and an indication when the customer can expect a more detailed answer.

If the complaint cannot be resolved by mutual agreement, a dispute will arise that is subject to the dispute settlement procedure.

Article 13 - Disputed

Only Belgian law applies to agreements between 4TC and the customer to which these general terms and conditions apply.

Article 14 - Additional or different provisions

Additional or deviating provisions from these general terms and conditions may not be to the detriment of the consumer and must be recorded in writing or in such a way that they can be stored by the consumer in an accessible manner on a durable data carrier.
